Geneva: China has notified the Dispute Settlement Body of its decision to appeal the panel report in the case brought by China in “United States — Safeguard Measure on Imports of Crystalline Silicon Photovoltaic Products”. The panel report was circulated to World Trade Organization (WTO) members on September2, 2021. The appeal was circulated to WTO members on September 20.
Given the ongoing lack of agreement among WTO members regarding the filling of Appellate Body vacancies, there is no Appellate Body Division available at the current time to deal with the appeal, the WTO stated here today.

China has regretted that currently no division of the Appellate Body can be established to hear this appeal in accordance with Article 17.1 of the Dispute Settlement Understanding. It stated that in this exceptional circumstance, and in the interests of fairness and orderly procedure in the conduct of the appeal, it will await further instructions from the division, when it may eventually be composed, or the Appellate Body, regarding any further steps to be taken by it in this appeal.
